Es handelt sich nicht um ein offenes Verfahren, sondern um ein sog. open-house-Modell! Das Formular für das offene Verfahren wird lediglich deshalb verwandt, da kein Formular für das open-house-Modell existiert. Verträge, die im open-house-Modell geschlossen werden, unterfallen mangels Auswahlentscheidung nicht dem Vergaberecht. Eine Unterwerfung unter vergaberechtliche Regelungen ist mit der Verwendung dieses Formulars nicht verbunden. Die AOK Bayern beabsichtigt, mit allen interessierten pharmazeutischen Unternehmen nicht-exklusive Rabattvereinbarungen über den Wirkstoff Pridinol, ATC M03BX03, nach § 130a Abs. 8 SGB V zu schließen. Die AOK Bayern bietet allen interessierten pharmazeutischen Unternehmen, die die unten genannten Eignungsvoraussetzungen erfüllen, den Abschluss identischer und nicht individuell verhandelbarer Rabattvereinbarungen an. Der frühestmögliche Vertragsbeginn ist der 01.12.2026, alle Verträge enden am 30.11.2028. Ein Vertragsschluss ist während dieser Laufzeit…
