Description
Postępowanie o udzielenie zamówienia publicznego prowadzone jest w trybie przetargu nieograniczonego, na podstawie inż. 132 ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych, zwanej dalej „ustawą Pzp”, przepisów wykonawczych wydanych na jej podstawie oraz Kodeksu Cywilnego. W zakresie nieuregulowanym niniejszą SWZ, zastosowanie mają przepisy ustawy Pzp. 2. Zamawiający, zgodnie z art. 139 ustawy Pzp , przewiduje odwróconą kolejność czynności, tj. może najpierw dokonać badania i oceny ofert, a następnie dokonać kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona w zakresie braku podstaw wykluczenia.Zamawiający wykluczy Wykonawców, którzy podlegają wykluczeniu na podstawie przesłanek, o których mowa w art. 108 ust. 1 ustawy Pzp i art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (Dz.
