Das vorliegende Verfahren unterliegt nicht dem Vergaberecht. Es handelt sich um ein Open-House-Verfahren. Im Interesse der Transparenz und einer möglichst breit angelegten Information der interessierten pharmazeutischen Unternehmer erfolgt diese Bekanntmachung im Supplement zum Amtsblatt der Europäischen Union. Soweit im Rahmen dieser Bekanntmachung Formulierungen verwendet werden, welche auf die Vergabe eines öffentlichen Auftrags hindeuten, ist dies allein den Vorgaben dieses Bekanntmachungsformulars geschuldet. Hiermit sowie mit der Nutzung des Mediums "TED" ist keine Unterwerfung unter vergaberechtliche Regelungen verbunden, deren Geltung kraft Gesetzes bzw. Vergabeordnungen und nach der Rechtsprechung des Europäischen Gerichtshofs nicht verpflichtend vorgegeben ist.
